Terms And Conditions
To use our services, you must agree to these terms. These terms and conditions are available at www.hireonplacements.ca. This is a legal agreement between you and us. You here refer to worker or employer collectively known as a user and us refers to HireOn Placements. You may not use the services if you do not accept these terms and conditions.
This agreement governs your use of our services which are provided by us through our mobile app and site. These terms of conditions tell about the limitations of the way each user uses our services. It must be strictly followed by each user. You can accept this agreement while registering by clicking on I Agree which acknowledges that you agree to be bound by the terms and conditions of this agreement. Moreover, you agree to any future amendments to this agreement. Please read these terms of service use carefully. If you do not agree to be bound by this agreement, you do not use our services, app anymore.
HireOn Placements provides a platform where each user has to register first with us to use our services. On our app potential workers can pick shifts according to their schedule which would be posted by various potential employers. Our services provide a chance for potential employers to meet with potential employees for temporary work.
By becoming a user and using the HireOn Placements platform you represent and warrant that:
You are at least 18 years old.
You are legally allowed to work in Canada.
You agree and authorize us to verify your representations and warranties.
You grant HireOn Placements a non-exclusive license to use your content.
You agree that HireOn Placements platform is provided AS IS and without warranty.
Content, service, and marks used on our platform are owned by us and subject to copyright. So, you agree not to use our content.
You agree that HireOn Placements is not responsible for the accuracy and usefulness of the content you may show on our platform.
You agree that HireOn Placementsplatform is solely for professional communication and has no liability for any professional services provided by third parties.
You agree with the limitations on liabilities on HireOn Placements given in the policy.
You agree to indemnify HireOn Placements from claims due to your use of our platform, misuse of our services, any third-party rights, and information shared by you with us.
You agree that in case of dispute either party can compel for arbitration, but in case of the informal dispute resolution process, you have to request that one month prior to the initiation of any claim.
You agree to any modifications to this agreement from time to time.
Explanation of the above points:
HireOn Placements is the source of communication:
HireOn Placements provides a platform where potential workers can easily meet with potential employers to get work or shift at their own convenient time or place. HireOn Placements itself does not provide any work or shift to the worker or act in any way as a worker for the employer. Every user must remain cautious while interacting with other users on our services. We are not liable for the shift posted by the employer or any conduct by the employer. We are not responsible and liable for any claim, injury, or damage that might arise at the workplace while working for the employer during the shift period.
Content sharing:
In order to use our services, every user must need to register with us. After creating or registering your account we will approve your account then you can access it through our services. After creating a username and password every user needs to share some personal information or documents. All this information must be correct, accurate, or updated otherwise in any case we suspect that this given information or content is not updated, incorrect or inaccurate then we reserve the right to suspend or terminate your account at any time in our sole discretion.
Every user is the sole authorized user of their account. You must protect your username, password, or account in any case and every time. You are responsible for all activities going on in your account. HireOn Placements has no access or control over your account by other users or the third party so will not be liable for this at any time. If you suspect any unauthorized access to your account then you must take it seriously. This case will not affect HireOn Placements's right to suspend or terminate any account.
By providing your phone number and emails you agree that you will receive phone calls or messages or emails from us regarding the services or shifts provided by our platform. HireOn Placements may send you emails regarding the shift details, payments, etc.
Account Deletion:
User can request to delete their account from the app itself or an email can be sent to support@hireonplacements.ca from the registered email to delete the account.
For worker: All the information shall be deleted only if a user hasn't worked with HireOn. If a user has worked with HireOn, the information might be retained to fulfill Govt. legal requirements.
For company: All the information shall be deleted only if a company never posted any shift on the app.
Payments:
Employers are obligated to pay within 24 hours after the shift is completed. The mode of payment will be email transfer or direct deposit. In case of any discrepancies like
1) HireOn Placements did not get paid on time.
2) Employer sent payment but HireOn Placements didn't get payment due to some technical issues with banking.
3) In case the employer is misleading HireOn Placements for sending payments, the employer will be solely responsible for all these situations, and HireOn Placements is free to take either arbitration method for resolving such dispute or could go to court proceedings.
Term and termination for the worker:
This agreement shall remain in full force and effect. We have the right to terminate or suspend your account at any time whenever we believe that you have breached this agreement or any other policy posted on our platform. If we find that you have engaged in some inappropriate actions or misconduct in that case also we can suspend or terminate your account without prior notice or message. Once you are terminated from our platform you will not be able to use our services and will not be able to register again with other names or email Ids. We also reserve the right to take legal action against you whenever we believe you are suspicious.
You may also terminate this Agreement by closing your account which you have opened. You also have to either complete your all picked shifts or unpick shifts if the pick start time is not less than 10 hours, otherwise, you have to pay a penalty for that.
Term and termination for the employer:
The employer may cancel any scheduled shift if the shift start time is not less than 10 hours. If the shift start time is less than 10 hours then, in that case, our platform will not allow you to cancel or delete that shift.
Policy for the dropped shift:
If in case any worker picked a scheduled shift but then unpicks that shift it will be considered as a dropped shift and automatically will show as an unpick shift on our platform. In this case, we cannot guarantee that shift will be picked by another worker, but try to provide a substitute in that case. We do not hold any responsibility or liability for this case.
Policy for the deleted shift:
The employer may delete a scheduled shift if the shift start time is not less than 10 hours. In case the shift is deleted we cannot guarantee to the worker that this deleted shift will be replaced by another scheduled shift for them. We will not be responsible or liable for the above case in any manner.
Policy for use of our services:
This agreement clarifies that any organization or entity will use our platform to post their job shifts from time to time, but not for any other purposes. In the same way, workers may use our services just to get work or shift according to their schedule. We expect restricted use of our platform from our users. Users (Workers or Employers) agree that they will not use our platform to:
Stealing content: Stealing or collecting information related to users using our platform, users of services, or any third party involved in our business by monitoring or by means of any software or technology that violates our terms of service use or privacy policy.
Copyright issues and improper disclosure: Using, controlling, accessing, or communicating any data or information or trademark, logos, trade secret, proprietary rights of any party either third party or us. More clearly, accessing or controlling, or removing any data or information from our services that you do not have the right to use or transmit according to the law including abusive, harmful, unlawful, threatening, or any objectionable information will violate our terms of services use.
Interfering with our security measures: The user does not have any right or access to interfere with our security measures related to our services. Users are not allowed to change any security terms with respect to data, file, or content transmission, storing that data on or through our platform.
Use of our platform for stealing usernames: No user must use our platform to collect usernames or email addresses of any other users by any means without our prior permission.
Violating rules or laws: Intentionally or unintentionally violating any rules or regulations or procedures which are applicable to the state, national, or international level. This is also applicable to rules related to security measures, rules and regulations, procedures, or policies which are in force from time to time related to our services.
Sending corrupt files or viruses: Sending or transmitting any content, data, file which can interfere with software, hardware, or disrupt our services or platform. Communicating any viruses while using our platform, modifying, deleting, or damaging any information of other users these all unauthorized manners are restricted by us.
Misrepresentation or deception: Maliciously impersonating a genuine system or user to gain control of vulnerable systems or user’s data. Impersonate any person or entity, forge headers or change identifiers in order to disguise the origin of data transmitted to users.
Defame other users: Abuse, defame, harass, stalk, threaten other users including us will lead to violating the legal rights.
Publish unlawful information: Upload, publish, post misleading, false, profane, threatening, or unlawful information, content, or material that involves the sale of stolen items.
Restricting others to use our platform
Register with different names or email addresses when your account is suspended or terminated will also violate legal rights.
Upload any type of content that is harmful, exploits anyone, sexual or obscene is against our policy.
No guarantee for work:
HireOn Placements platform provides a way to connect potential workers to potential employers. Any employer after registering with us can use our services and post a job on our app at any time. In the same way, any registered worker can pick a shift or job from our app. But this does not guarantee the worker employment. We are not the employer.
Copyright issues:
HireOn Placements expects you to respect the intellectual property of others. In case of copyright infringement notices HireOn Placements will investigate and if it determines that content is infringing then we will take appropriate action against that entity or person who is violating our agreement. HireOn Placements will remove such content and terminate the access of users who posted information on our platform. If you believe that your work has been copied and it involves copyright infringement then you must provide this information in the notice to our copyright agent:
A statement comprising intellectual property rights that are infringed.
A full description of copyrighted or intellectual property work that you believe is infringed.
The exact location of the copyrighted work so that it will be easy for us to investigate after looking at the copyrighted content.
Your address, contact details, phone number, email address.
A statement by you that you have good faith belief that the use of copyrighted information is not authorized by the owner of rights, its agents, or by law.
A statement by you, made under the penalty of perjury, that the above information given in your notice is accurate and you will act on the behalf of the owner of the copyright or other intellectual property rights that are being infringed.
An electronic or physical signature of a person who will act on behalf of the owner of the intellectual property rights that are being infringed.
Intellectual property rights:
All the information, data, and content material on our platform is the property of HireOn Placements. HireOn Placements is the sole and exclusive owner of all rights, interests in, and to all intellectual rights associated with HireOn Placements. Trademarks, logos, and service marks all are property of HireOn Placements. The use of our intellectual content without our prior written permission is prohibited.
Time to time special offers:
HireOn Placements may provide certain special offers from time to time at their sole discretion. We can change, remove, or modify any offer at any time without prior notice. HireOn Placements may use gift cards as promotional offers which may be used in part or full. There will be no associated fees with the use of cards. In case of damage, lost or stolen cards cannot be replaced. In case we find cards are obtained through unauthorized means then we can cancel the gift card. These terms and conditions related to gift cards are subject to change at any time without notice.
Change-related to our services, app, or website:
We have the right to change, discontinue, modify, remove, and improve any content or information on our platform without notice and we will not be liable for anything related to this.
Confidentiality:
Confidentiality relates to any content or information of HireOn Placements that is not known to the public or other third parties. This information is known to people who have been assigned a password or some encrypted key to that information. By this, you agree that you will not use, harm such as confidential information of the Corp.
Disclaimer of warranties:
Mutual arbitration agreement:
In case of any dispute or claim whether it is of past, present, or future between you and HireOn Placements or in any other case like disagreement to policy or terms, you and HireOn Placements may attempt informal negotiations before going to court or court proceeding. For negotiation, the user must submit written notice for that. If you and HireOn Placements fail to resolve the dispute informally then you and HireOn Placements agree to resolve the dispute through binding arbitration. This binding arbitration doesn’t apply to excluded disputes which are:
Any dispute related to intellectual property rights
Claims which cannot be resolved by arbitration as stated by law
Any claim for injunctive relief.
You agree that any dispute or claim can be brought on an individual basis but not as a class. Applicability, formation, or enforcement of class can only be determined by the court, not by an arbitrator. An individual who wants to arbitrate a dispute must start an arbitration proceeding no later than the expiration of the statute of Limitations. The arbitrator may award any remedy and apply any different substantive law. Parties are allowed to present their witnesses, and proofs. The location of arbitration proceedings may be decided by the party and HireOn Placements. You and HireOn Placements agree that if any portion of this agreement is found unenforceable then that part is assumed to be severed and the rest of the part will remain in force and effect.
Indemnification:
You agree to indemnify and hold harmless HireOn Placements, directors, its members, employees, contractors, and vendors from and against any and all claims, liability, expenses, damages, and losses related to
Use of our services or platform or inability to use our services
Your violation of laws and regulation
Your violation of this agreement
Your information or content shared by you to use our services
Your violation of the rights of others.
Without the prior consent of HireOn Placements, you are not allowed to settle such claims or matters.
General terms:
HireOn Placements does not make any representation regarding the use of our services or app from outside of Canada. If you do so then you are using it on your own responsibility. This agreement is governed according to the rules of the Province of British Columbia. In case we fail to enforce any provision of this agreement then it will not be considered a waiver of any provision. If any provision or part of this agreement is found to be unenforceable then another part of the agreement remains in full force and effect. In case of any dispute or claim arising from this agreement then you and HireOn Placements agree to submit to the jurisdiction of the Canadian Government to resolve the matter. Even according to the agreement between you and us we can use other injunctive remedies to solve the dispute. HireOn Placements will not be liable in case of interrupted services due to various situations like a flood, strike, fire, explosion, lockouts, system failure, server down, or terrorist attack.
Modification in agreement:
We reserve the right to modify, update, delete, or remove any part, content, or information of this agreement at any time without any notice. If any user wants to use our platform or services then you must agree with these terms and conditions and any changes in the future in this agreement.
Limitations on the use of our platform:
We expect the restricted use of our platform from our users. Users agree that they will not use our platform to:

HireOn Placements has the right to decide whether any user or content shared by any user violates the terms of service. If yes, in that case, HireOn Placements removes that content or terminates that user from using our services or platform without prior notice and at its sole discretion.
Agreement for the worker:
Showing consent to our agreement:
Workers or employees who are using our services must agree with these provisions given to workers. Workers must show their consent to act in accordance with the provisions of this employment agreement. If a worker does not agree to or violates this agreement may be terminated by us without any prior notice. HireOn Placements has the right to restrict the use of its services by any worker who breaches this agreement.
Sharing personal content or information:
By creating your user account with us, you agree to share your personal information including name, address, photograph, date of birth, Social insurance number, experience information, contact information, and email address with us, and with other potential employers.
Employers may use your personal information to verify your identity. For eg. If someone picks a shift from our app or a person booked a shift manually to work with any of our clients then we may share some personal information with the client so that the client can match your identity. To verify your identity, the client may call you or may ask you to show a photo id before starting the shift to match your information with available information shared by us.
The User’s Social insurance number, credit card information, or bank details will not be shared by us with other employers or third parties.
The use of our services does not guarantee a job or wages:
Worker's use of services does not guarantee job opportunities. HireOn Placements is a platform where potential employees can meet potential employers. But it does not guarantee to find a job for every person or employee registered with us. We shall not have any obligation to you to find a job. We will not be even liable in case of failure to provide you with employment opportunities.
Follow all provincial laws:
HireOn Placements strictly follows all labor laws of BC. So, every user must show a belief in those laws. You should follow all necessary guidelines for break time, overtime, or anything else which is necessary at the workplace.
Paying taxes is solely the responsibility of the worker:
Paying taxes is a good perspective in order to help the economy of our residing country. So, the user is solely responsible for paying taxes to their residing country. These taxes include federal taxes, provincial taxes, or other payroll taxes applicable to you when you receive any employment help from the use of our platform. We also reserve the right to withhold some of the taxes from your payments to satisfy applicable laws. You show your consent that in case you are not able to pay taxes which are due then it is not our responsibility or it will not cause any trouble to us.
The worker is not allowed to set up direct contact with the employer:
Any worker registering on our app or using our services cannot hold permission to directly contact the employer. In case any worker wants to contact any potential employer then the worker must inform us. The worker needs to get approval from our side to arrange communication between worker and employer. After that, we can help them by arranging a proper meeting between employer and worker.
T4 slips
Creating an account with us means you are agreeing to send T4 slips with password protection over the given email by you.
Disclaims any and all liability:
HireOn Placements disclaims any and all liability against any damages, costs, or expenses. It includes other liabilities including action, inaction, incorrect communication, or misbehavior of an employer. HireOn Placements is not responsible for the conduct of any employer. Although our platform restricts workers to pick 2 shifts and working more than 8 hrs in a day, if workers are able to pick 2 shifts or work more than 8 hrs in a day then it's their own sole responsibility and HireOn Placements will not be liable for any overtime payments.
Check the app regularly for updated information. The employer can delete a shift even if the shift start time is less than 10 hours and in an unpick state. In that case, every worker should regularly check their app for updated information. We send emails but it is your responsibility to check whether your picked shift status is the same or it is deleted. If deleted, no need to rush to the workplace. Start looking for another job. HireOn Placements will not be liable for this case.
Agreement for the employer:
Employers registering with us or using our services must agree to the following:
You are a bonafide warehousing, shipping, logistics, or similar organization. You must have a proper license to establish an organization or to provide temporary employment to general people.
You will not show discrimination while selecting a temporary employee on the basis of sex, race, color, ethnicity, origin, age, family status, religion, sexual orientation, gender identity, or pregnancy.
You will not misbehave with any of your employees. You will not use abusive language, not harass them at any time.
You will provide the necessary information while posting the job on our platform so that no employee gets confused regarding anything and can easily complete their shift.
You will follow all rules and regulations regarding your establishment. In case of violation of any of these rules, you solely will be responsible.
You agree that you will be solely responsible for the identity check of the worker before starting the shift at the workplace.
By registering with us, you will be able to get staff on a temporary basis, but not for recruitment.
Any potential employee with whom you will come in contact through our platform will be just for communication related to shifts or work. You will not contact any employee for any other purposes.
By registering with us you agree that you will timely pay HireOn Placements for providing you inspiring staff whenever and wherever you require. You will pay for each staff after that shift completes irrespective of employee performance at the workplace.
You agree that we reserve the right to revise the fees for a shift at any time. It is your responsibility to remain updated with our fee structure.
You agree that you will be responsible for all necessary taxes, and fees related to your licensed establishment or services you provide.
You agree that you will follow all rules and regulations regarding break time, overtime, or other safety measures at the workplace. You agree that every employee will get 30 minutes unpaid break after 5 hours of shift according to BC labor laws.
The employer can delete a shift if the shift start time is less than 10 hours and in an unpick state but you agree that you will not do it unnecessarily rather you will check the possibility of deletion of that shift before posting the shift. If you found it reliable then only you will post that shift otherwise not.
